Not all workers will have the option to opt out of NEST and it’s important to understand which enrolment types do. The table below shows which members will be able to opt out:

Ongoing duties
If a worker opts out and then changes their mind within 12 months of their enrolment, they can ask you to re-enrol them but you aren’t required to do this unless you wish to. If this happens, you can re-enrol the worker using the opt in enrolment category.
Every three years you must also re-enrol any of your workers who previously opted out, if they’re eligible for auto enrolment and they aren’t already in a qualifying scheme.
This includes workers who’ve previously stopped making contributions, as well as workers who’ve opted out.
Your first re-enrolment date is set as three years from your staging date but you’ll have the flexibility to choose any date within three months before or after that date to fit around your normal processes.
All eligible workers need to be re-assessed on the date you choose. You won’t need to re-enrol anyone who stopped contributing or opted out within the 12 months running up to your re-enrolment date.
